Purchase Contract
This agreement is made and hereby entered into, on this ___day of _______________by and between Kharissa Petras (hereafter referred to as “Seller”, and _______________________ (hereafter referred to as “Buyer”), for the purpose of setting forth the terms and conditions of the purchase by the Buyer of a purebred WelshTerrier puppy.
1.) The Seller agrees to sell and the Buyer agrees to buy one (circle appropriate ) male __female Welsh Terrier puppy.
2.) The puppy is healthy, to the best of the Sellers’ knowledge. Buyer is receiving a copy of the puppy’s health/immunization record. Seller gives a one year health guarantee against any inheritable diseases. The Buyer has 72 hours after the receipt of the puppy to have it examined by a licensed Veterinarian. If, as a result of the examination, the Veterinarian determines the puppy is diseased or has a congenital disorder, then the Buyer shall elect to keep the puppy or return the puppy to the Seller for a refund of the purchase price or the Seller will replace the puppy at the Seller’s option. If the Buyer elects to return the puppy, the Buyer shall within 10 days after receipt of puppy send to the Seller, by certified mail, a written Veterinarian’s Certificate stating that the puppy’s disease or congenital disorder. Upon receipt of the puppy, the Seller shall be obligated to refund purchase price or replace the puppy as soon as one is available, and further performance under this contract shall be null and void. All action taken to return the puppy shall be with the best interest of the puppy in mind, including temperature at time of shipment, non-stop flights, etc.
3.) The Buyer understands that the puppy is of the WelshTerrier breed standard set forth by the AKC at this age, therefore waives any and all claims regarding the puppy’s conformation and outward appearance. Buyer also understands unless otherwise stipulated, AKC papers will be with limited registration.
4.) The Buyer agrees that any and all transportation costs, from and/or to Seller’s premises, will be at the cost and sole responsibility of the Buyer.
5.) The Buyer agrees to maintain preventative health care of the puppy including, but no limited to: inoculations, internal as well as external parasites, heartworm medication.
6.) The Buyer agrees to maintain preventative care of the puppy in regards to hip dysphasia, such as proper nutrition, proper exercise and preventing stress injuries (i.e. not allowing the puppy to jump from heights taller than itself at the shoulder.)
7.) Ownership of the puppy shall be transferred to the Buyer for the sale price of $650 + shipping if required ($250) to be paid in full on or before puppy’s 6 week birthday. Only after the full amount of the agreed upon purchase price, plus shipping if applicable, is paid, may the puppy be removed from the Seller’s premises. If the balance is left unpaid by such date as of , the agreement shall be canceled at the Seller’s option and the Buyer shall forfeit the deposit given hereunder.
8.) The Buyer understands the Seller highly recommends the puppy be spayed/ neutered by the time it is of at least six months of age. Please seek the advice of a licensed Veterinarian.
9.) The Seller will not reimburse Buyer for any Veterinarian bills that may be incurred. Seller is not responsible for boarding, maintenance, loss of emotional benefit, consequential damages or any other liability.
This Agreement is made and signed by both parties to insure the well being and protection of this animal. If any of this Agreement is breached, the Seller is released from any further obligations hereunder.
